Terms of Service

General Terms
🥀 Info:
The following Terms of Service are used for sharing the information regarding the terms that I, the Artist, have when proceeding with commission work like what my policies are over on copyright, licenses, payment & so forth. Please note these terms are subjected to change.Here is a brief overview of my general terms but not limited too of what’s in my TOS:✧ ALL commissions are digital goods not physical goods; & ALL commissions requested must be submitted through the form.✧ VampiressViolet reserves the right to refuse any commissions. No questions asked.✧ Upon delivery, commissions will not be resold or redistributed by VampiressViolet unless otherwise agreed upon with the clientele.✧ By default, VampiressViolet reserves the right to use commissions for self-promotion; i.e. Social Posts, Streaming Processes, Video Processes; & so forth. Full Privacy may incur additional fees & must be notified by the clientele prior to any payment.✧ VampiressViolet reserves the right to cancel any order if there is strong animosity between the artist & clientele.✧ Upon payment, the clientele is expected to keep VampiressViolet informed of any update of their contact information. If all information provided becomes unusable before the start of the order & the clientele can no longer be reached, the commission will be canceled after ten business days. The client will no longer be eligible for a refund.✧ Prices are final & non-negotiable. Any attempt to negotiate pricing will result in VampiressViolet declining the request.✧ Using commissioned products in ANY blockchain-related technology, such as but not limited to NFTs, Cryptocurrency, & so on; & in ANY AI/ML model training, & so on, is strictly prohibited.Copyright & Usage
🥀 Terms:
✧ VampiressViolet disclaims any responsibility for copyright issues. By providing material such as sound effects, artwork, fonts, & so on, for VampiressViolet to use, the clientele guarantees ownership of the correct licenses.✧ The clientele does not have the right to repurpose, redistribute, or edit any of the commissioned products unless an Extended License has been provided by VampiressViolet.✧ The clientele does not have the right to claim the commission as their own work, even after purchasing an Extended License & editing the design.✧ If the clientele purchases any editable source files, such as .PSD, .AI, .AEP Files, they are authorized to modify the product but not repurpose or redistribute it unless an Extended License has been provided by VampiressViolet.✧ Under Personal Use, the clientele is encouraged to credit VampiressViolet by username (VampiressViolet), Twitter handle (@VampiressViolet), or website URL (http://vampiressviolet.carrd.co/# OR http://ko-fi.com/vampiressviolet) on any platform where the commission is displayed publicly.✧ Under Commercial Use, the clientele must credit VampiressViolet by username, Twitter handle, or website URL on any platform where the commission is displayed publicly.Payment, Discounts, & Refunds
🥀 Payment & Fees:
✧ ALL Payments are requested through PayPal invoice in USD ($).✧ Payment must be made in full upfront. Invoice totals that are larger in price can be paid partially upon request: 50% will be due upfront & the remaining 50% will be due upon approval of sketches/draft designs.✧ A 5% flat-rate fee is applied to every order to cover administrative costs & fees. This will be shown in the invoice.🥀 Delivery Options:
✧ By default, commissions can take one week up to three weeks or longer to complete depending on communication, workload, timeframe & complexity of the project.✧ By default, the order will be completed when the clientele's slot in the queue is reached. Delivery may be delayed by deadline orders or IRL happenings. Any delay affecting a commission, will be notified to the clientele as soon as possible.✧ The clientele can request a deadline for their commission. If the project is accepted, a +50% to +80% fee per item will be applied to the order, based on workload, timeframe & complexity of the project. Deadline orders must be paid in full upfront.✧ The clientele can request a non-disclosure agreement (NDA) for their commission. Progress & final product will be kept private & will only be shared to the client & any other party directly involved with the commission, with prior approval from the clientele. A +30% fee will be applied to the order & the client will receive a Non-Disclosure Agreement PDF document to review & sign electronically.🥀 Cancellation, Refunds, & Chargebacks:
✧ Administrative costs & fees are excluded from all refunds.✧ The clientele is eligible for a refund, if the commission is canceled prior to the start of the project.✧ The clientele is no longer eligible for a refund, if they choose to cancel after the commission project has been started.✧ If VampiressViolet fails to meet a deadline or any other requirement requested in the initial agreement, the client will be eligible for a partial refund.✧ Chargebacks are strictly prohibited.✧ Repeatedly canceling commissions will result in immediate blacklisting.✧ Purposeful chargebacks with no prior notifications to VampiressViolet will result in immediate blacklisting including public display of: e-mail address, PayPal email address and Social media handles.Licenses
🥀 Personal Use:
✧ By default, commissions are delivered for Personal Use. The client is allowed to:
✧ Use any commissioned product on Twitch, YouTube for monetized content,
✧ Use any commissioned product on Social media platforms such as Discord, Twitter, Instagram, TikTok, etc...✧ Without prior approval or an appropriate license purchase, the client is not allowed to:
✧ Use any commissioned product to produce merch or prints
✧ Use any commission product for paid content (Patreon, Ko-fi membership...)
✧ Resell any commissioned product
✧ Redistribute any commissioned product
✧ Edit any commissioned product🥀 Commercial Use:
✧ A Commercial License incurs a +100% fee per item. It can be purchased separately from the item at any time. Upon purchase of a Commercial license, the clientele will receive a License Agreement PDF document to review and sign electronically.✧ Upon purchase of a Commercial License, the client is allowed to:
✧ Use any commissioned product on Twitch, YouTube for monetized content,
✧ Use any commissioned product on Social media platforms such as Discord, Twitter, Instagram, TikTok, etc…
✧ Use any commissioned product to produce merch or prints
✧ Use any commission product for paid content (Patreon, Ko-fi membership...)✧ Without prior approval or an appropriate license purchase, the client is not allowed to:
✧ Resell any commissioned product
✧ Redistribute any commissioned product
✧ Edit any commissioned product✧ License purchases are not eligible for discounts.✧ A commercial license cannot be transferred without prior written & signed agreement.✧ Under Commercial Use, the client must credit VampiressViolet by username (VampiressViolet), Twitter handle (@VampiressViolet) or website URL (vampiressviolet.carrd.co OR ko-fi.com/vampiressviolet) on any platform where the commission is displayed publicly.🥀 Extended Use:
✧ An Extended license incurs a +300% fee per item. It can be purchased separately from the item at any time. Upon purchase of an Extended license, the client will receive a License Agreement PDF document to review & sign electronically.✧ Upon purchase of an Extended license, the client is allowed to:
✧ Use any commissioned product on Twitch, YouTube for monetized content,
✧ Use any commissioned product on Social media platforms such as Discord, Twitter, Instagram, TikTok, etc…
✧ Use any commissioned product to produce merch or prints
✧ Use any commission product for paid content (Patreon, Ko-fi membership...)
✧ Resell any commissioned product
✧ Redistribute any commissioned product
✧ Edit any commissioned product✧ License purchases are not eligible for discounts. An extended license cannot be transferred without prior written and signed agreement.✧ Under commercial use, the client must credit VampiressViolet by username (VampiressViolet), Twitter handle (@VampiressViolet) or website URL (http://vampiressviolet.carrd.co/# OR http://ko-fi.com/vampiressviolet) on any platform where the commission is displayed publicly.✧ If a commissioned product is altered, VampiressViolet must still be credited as the original designer.Confidentiality
🥀 Privacy Policy:
✧ Neither Party (VampiressViolet & the clientele) shall use, disclose or make available to any third party the other Party’s Confidential Information, unless such use or disclosure is done in accordance with VampiressViolet’s Terms of Use.✧ Each Party must hold the other Party’s Confidential Information secure & in confidence, except to the extent that such Confidential Information:
a.) is required to be disclosed according to the requirements of any law, judicial or legislative body or government agency; or
b.) was approved for release in writing by the other Party, but only to the extent of and subject to such conditions as may be imposed in such written authorization.✧ This clause will survive cancellation of the commission and any other agreement & license.Commission Process
🥀 Inquiry:
✧ Upon receipt of a commission form, VampiressViolet will review the request & contact the client. Based on the information provided, a PDF document including contact information, commission details, pricing & estimated delivery will be generated & sent to the client for approval.✧ If the information provided does not meet the clientele's expectations, they may decline the order.✧ If the information provided is approved by the clientele, a PayPal invoice will be sent.✧ Upon receipt of payment, the clientele will lock their slot in the queue & will no longer be able to add or remove any item they ordered. Minor edits on items that are already in the initial agreement are accepted.🥀 Design Process:
✧ Once a project has been started, the clientele is expected to provide feedback on each version VampiressViolet is providing. If the client fails to provide feedback, the commission will be put on hold.✧ Tip: Feedback should be concise. The clientele is encouraged to send all feedback at once to avoid quickly consuming revisions. So please take, at the minimum, a day to review before sending feedback.✧ Once the project starts, the clientele will receive regular updates throughout the entire process. All drafts will be watermarked.✧ During the early stage (sketch/draft), the clientele may request up to 5 revisions per item for free. Additional revisions will incur an extra 3% fee per edit.✧ During the second stage (lineart, base colors, layer separation), the clientele may request unlimited minor revisions (color fix, minor illustration edit) per item for free. Major revisions (destructive edits completely different from the initial request) will incur a 10% fee per edit.✧ During the final stage (shading, animation–where applicable–, & final touches), the clientele may request up to 2 minor revisions per item for free. Major revisions will be charged the initial cost of the item.🥀 Delivery:
✧ Any additional fees must be paid prior to delivery.✧ Once the project is completed, the clientele will receive a final showcase version of the entire commission to ensure they're satisfied with the products.✧ Once approved, the files will be sent unwatermarked at full resolution through email & the commission will be closed.🥀 What I Will & Won’t Do: What I won’t do:
✧ Draw Hate of ANY kind
✧ Draw NSFW (Lewd-ish stuff is okay)
✧ Draw Political Topics/Subjects
✧ Draw NFTs/Blockchain, AI/ML Model Training, & so on
✧ Backgrounds–for now–simple ones are okay
✧ Animals–it’ll vary on this depending a lot on complexity & such, as I’m still learningWhat I will do:
✧ Draw Humans, Humanoids, etc.
✧ Draw Cute, Gore, Lewd, etc.
✧ I am comfortable drawing a majority of things, however, there may be things I’ll be doing for the first time & will provide my best work I possibly can at that time. Thank You in advance for trusting me to do so.Thank You for Reading!
